Abstract

A abstração jurídica da “propriedade intelectual” surgiu para estimular a(o) criador(a) e beneficiar a sociedade. As idéias, imateriais por natureza, precisam de um suporte material para a aplicação desse artifício. No entanto, as tecnologias digitais tornaram o suporte irrelevante. As criações humanas passaram a ser facilmente compartilháveis através de cópias perfeitas. Neste contexto, manter uma escassez artificial no campo da informação é um dos maiores desafios do capitalismo. A luz de tais mudanças, o autor propõe a desconstrução do conceito de “propriedade intelectual” e uma reflexão sobre a validade das bases teóricas em que se apoiam os atuais mecanismos de regulação do fluxo do conhecimento, apontando para mudanças que proporcionariam um tratamento mais realista à questão. Desconstructing “Intellectual Property” The juridical abstraction of “intellectual property” was introduced to stimulate the creator and to benefit the society. Ideas, immaterial by nature, need physical support for the application of that legal artifice. However, digital technologies within computer world turned the support irrelevant. The human creations had started to be easily shared through perfect copies. In that context, maintain an artificial scarcity in the field of information is one of the greatest challenges of capitalism. Face to such changes, the author suggests the deconstruction of the concept of “intellectual property” in order to reflect on the validity of the theoretical basis of the current mechanisms of regulation of the flow of knowledge and appoint the changes that would provide a more realistic treatment of the question.
